4.1 Meaning of Demise Charter

It is a charter party by which a ship is let by demise and under which the demise charterer for the time being has the possession of the ship and has the control of all matters relating to the navigation and operation of the ship including employment of the master and crew.

4.2 Ship on Demise Charter

A ship on demise charter to a body corporate which is a Qualified Person (paragraph 1.6) can be on full or provisional registration. However, no dual registration is allowed. The registration is valid for the period of the demise charter and any change to the owner or demise charterer will render the ship unregistrable.

4.3 Procedures to register a ship on Demise Charter

The procedures for full or provisional registration of a vessel on demise charter will be the same as described in Sections 2 and 3 above as appropriate. In addition, the following documents will need to be submitted :  
  1. Form of Authority for making and signing application and declaration by the demise charterer (Form No. "M.O. 812"), where necessary.
  2. Original or certified true copy of Certificate of Incorporation or Registration of the demise charterer in Hong Kong.
  3. Declaration of Entitlement to register a ship in Hong Kong by the demise charterer (Form No. "RS/D6"), together with a true and complete copy of the demise charterparty made between the owner and the demise charterer.
